Consumer Opt-Out on FOX Audience Network

The FOX Audience Network ("FAN") enables marketers of all sizes to find and connect with customized audiences across the Internet. With its massive reach and the industry's leading customization and reporting platform, FAN is able to maximize return on investment for marketers and revenues for publishers while creating an altogether more relevant experience for users across the web.

Use of Cookies and other Technologies

FAN uses cookies on publisher websites with whom FAN does business ("FAN Network Websites"). Cookies are small bits of information that FAN places on users' computers. The cookies used by FAN do not contain any personally identifiable information. FAN places a cookie on a user's computer, and websites using FAN recognize the cookie when the user visits those sites. FAN uses two types of cookies: a session cookie and a persistent cookie. A session cookie is temporarily stored on a user's computer and is removed when the user closes the web browser or turns off the computer. A persistent cookie remains on the user's computer after the user closes the web browser and may be used when the user returns to a FAN Website. FAN also may use web beacons, which are 1x1 pixels placed in a Web page, or other similar monitoring technologies. FAN receives non-PII such as IP addresses, cookie information, referring URLs, browser type, aggregate user data, and, at times, anonymized non-PII profile data in connection with serving advertisements (both customized and non-customized) on FAN Network Websites. FAN may obtain from FAN Network Websites non-personally identifiable information in conjunction with other non-personally identifiable profile-based and interest-based information, and use that information to better customize advertisements.

FAN and third parties may monitor advertisements placed on FAN Network Websites and use non-personally identifiable information obtained from cookies, web beacons, and/or other similar monitoring technologies for the purpose of reporting website traffic, data and statistics collection, advertisements, "click-throughs," to predict responses to advertisements and help determine the effectiveness and appropriateness of certain advertisements and content, to provide other services to FAN Network Websites, and/or for other activities. FAN also may use non-personally identifiable information in conjunction with other non-personally identifiable profile-based and interest-based information for these activities, including enhancement of FAN's customized advertising services. In addition, FAN may use non-personally identifiable information to help FAN and FAN Network Websites customize advertising and content and optimize the user experience for consumers on other third party publisher websites. FAN may use non-personally identifiable profile-based and interest-based information obtained from FAN Network Websites for these activities as well. FAN may also combine non-personally identifiable information with other non-personally identifiable information that FAN obtains from other sources.

Third Party Service Providers

FAN may contract with a third party to provide some part of FAN's services. FAN may provide non-personally identifiable information on an anonymous basis to such third party, and such third party may collect non-personally identifiable information on FAN's behalf. Such third parties are authorized to collect, use and process non-personally identifiable information only as authorized by FAN, consistent with this policy.

Other than as described above, non-personally identifiable information will not be transferred to third parties without user permission, except as required by law or pursuant to a sale, merger, or other transfer of FAN.

Opt-out

Users may opt-out of FAN customized ad serving. If a user does not wish to receive customized advertisements based on the non-personally identifiable information stored in a FAN cookie or beacon, the user may opt-out at http://www.networkadvertising.org/managing/opt_out.asp. Opting out of FAN customized targeting ad serving does not remove advertisements; if a user opts out, the user will continue to see advertising, but the advertising will not be customized based on behavior, previous activity, or other information previously associated with the FAN cookie or beacon. Specifically, if a user has opted out, FAN will no longer customize advertisements to that user based on any profile or interest-based data collected from the user. FAN also will continue to collect ad reporting and delivery data (defined below) from a user that has opted out, but FAN will not merge this data to data previously collected from that user’s activity. FAN also will continue to retain historical data collected from that user prior to his or her opt-out election (subject to FAN's data retention policy detailed below). Once a user has opted out, FAN will not customize the advertisements a user sees based on that historical data. Certain aggregated non-personally identifiable information and attributes will be retained by FAN after a user has opted out; FAN will use it only for internal reference and analysis.

If the user changes browsers or computers, or deletes the cookies on his or her computer, the user will need to opt-out again. Users also can program their computers to notify them each time a cookie is being sent, block third party cookies or block all cookies.

Data Retention

For a period of time, FAN is required to retain certain non-personally identifiable information from all users in order to provide audited information to FAN Network Websites and auditors related to the number of ads served, and actions taken, as a result of FAN ad serving (“ad reporting and delivery data”). Log files that associate individual advertisements with a specific IP address will be retained by FAN for no longer than 15 months for internal analysis and ad reporting and delivery purposes. Certain aggregated non-personally identifiable information and attributes, including historical data obtained by FAN prior to an opt-out election and the fact that the user has opted out, continue to be associated with the user's cookie, regardless of opt-out state.

Changes to this Policy

This policy may be updated periodically to reflect industry initiatives, changes in the law, or as FAN adds, removes, or modifies its services and procedures regarding the collection and use of non-personally identifiable information for ad serving and customization. Other than as described above, non-personally identifiable information will not be transferred to third parties without user permission, except as required by law or pursuant to a sale, merger, or other transfer of FAN. All material changes to this policy will be disclosed in a clear and conspicuous manner on www.FOXaudiencenetwork.com.
